The Narcotics Control Bureau conducted a raid on a cruise ship on October 3, taking into custody Aryan Khan and seven others. While most were sent away after being questioned, Aryan, Arbaaz Merchant and Munmun Dhamecha were taken in custody by the NCB and sent to jail.  After several attempts of getting a bail for the three, a single bench of Justice NW Sambre has finally granted bail to the three and in his statement said, “All three pleas are allowed. I will pass detailed orders by tomorrow evening,” Justice Sambre said. The accused, however, will not be released from jail tonight.”

During the bail plea, the NCB’s counsel ASG Anil Singh said, “There is a case that a person might not have consumed the drug, but if he’s in possession of it, he can be booked under NDPS Act… Accused Aryan was found in conscious possession of contraband.”

Counter argument by Senior Advocate Amit Desai was that the case was illegal as the agency failed to follow procedure under section 41A of the Criminal Procedure Code (CrPC) that mandates the officer to issue notice of appearance prior to arrest. He also contested the WhatsApp chats used as evidence as they are not not admissible in court, according to previous High Court judgments and provisions of the Indian Evidence Act.
